What Happens If an Invoice Should Have Been E-Invoiced but Wasn’t?
GSTZone Desk · Updated 2026
Short answer
It’s treated as legally invalid as a tax invoice โ meaning the recipient cannot claim ITC on it, e-way bill generation can be blocked, and the issuer faces a penalty of โน10,000 per invoice (or the amount of tax evaded, whichever is higher) under Section 122.
In detail
Rule 48(5) is unambiguous about this: for a business required to e-invoice, an invoice issued WITHOUT going through the e-invoice registration portal and getting an Invoice Reference Number (IRN) is deemed to not be a valid invoice at all โ regardless of how correctly formatted and accurate the actual document looks.
That invalidity flows downstream to the BUYER’s ITC too โ a recipient generally cannot claim input tax credit on a supposed ‘tax invoice’ that legally doesn’t count as one, even if they’ve genuinely paid for the goods and the GST charged.
The fix, if caught in time, is to properly register the invoice on the e-invoice portal to generate the missing IRN, or where appropriate cancel and reissue the invoice correctly โ the earlier this is corrected, the less disruption it causes to the buyer’s ITC timeline.
GSTZone tip
If your business crossed the e-invoice threshold recently, audit a sample of your actual invoices issued in the following weeks specifically to confirm every one carries a valid IRN and QR code โ a common failure point is a billing system that wasn’t properly integrated with the e-invoice portal on day one.
Related questions
Can a missing e-invoice be fixed after the fact?+
If it’s caught before the return period closes, generating the IRN belatedly or reissuing the invoice correctly is possible; once returns are filed and the recipient has acted on it, the fix becomes more complicated.
Does this apply to B2C invoices too?+
No โ since e-invoicing generally covers B2B and export invoices, this specific invalidity consequence applies to those categories, not to ordinary B2C retail invoices.
