I Renewed Health Insurance for 3 Years Before Sept 22 โ€” Do I Get GST Refunded Now It’s Exempt?

Short answer

No โ€” GST is determined by the time of supply, generally when the premium is received. If you paid your premium (and GST was correctly charged at the time) before the health insurance exemption came into effect, that tax was validly levied for that transaction and isn’t retrospectively refundable just because the rate changed afterward for new transactions.

In detail

This is a natural but mistaken assumption โ€” that a rate change (or a full exemption) somehow reaches backward and un-does tax that was correctly charged before the change took effect. That’s not how GST’s time-of-supply principle works.

The GST rate applicable to any specific transaction is locked in based on the time of supply for THAT transaction โ€” broadly, when the invoice was issued and payment received. If you paid a 3-year advance premium before the health insurance exemption’s effective date, GST at the then-applicable rate (18%) was correctly charged and collected on that entire premium, and that’s the final tax position for that transaction.

The exemption applies going forward, to premiums received or policies issued from its effective date onward โ€” it doesn’t reopen or reprocess transactions that were already validly completed under the old rate, no matter how the coverage period of that policy extends into the future.
