Penalty for Late Filing of GST Returns
GSTZone Desk · Updated 2026
Short answer
Late filing attracts a late fee of โน50 per day (โน25 CGST + โน25 SGST) for a return with tax liability, or โน20 per day for a nil return โ both capped depending on your turnover โ plus 18% annual interest on any tax actually paid late.
In detail
Two separate charges apply, and it’s worth not confusing them. The late FEE is a flat daily charge purely for filing after the due date, regardless of whether you actually owed any tax that month. The INTEREST, separately, is 18% per annum calculated only on tax that was genuinely due and paid late โ a nil return with zero tax liability attracts only the late fee, no interest.
The daily late fee isn’t unlimited โ it’s capped, with the cap amount varying by your annual turnover slab, a structure introduced specifically to stop small businesses from accumulating an enormous late fee on a return that was only a few days late.
Filing a nil return late still costs something โ the โน20-per-day rate (versus โน50) recognises that no tax was actually at stake, but it doesn’t waive the fee for filing late entirely.
GSTZone tip
If you’re going to be late anyway, file the return as soon as you can rather than waiting to ‘batch’ multiple pending months together โ the late fee accrues per day, per return, so delaying compounds the cost across every pending period simultaneously.
Related questions
Is there ever an amnesty that waives the late fee?+
Yes โ the government has periodically announced late-fee waiver or reduction schemes for specific return periods; these are time-bound and announced separately, so it’s worth checking if one currently applies to your pending returns rather than assuming the standard fee is fixed forever.
Does the late fee apply separately to GSTR-1 and GSTR-3B?+
Yes โ GSTR-1 and GSTR-3B each carry their own independent late fee if filed late, so being late on both for the same month means paying the late fee twice.
