Short answer
File Form GST APL-01 before the jurisdictional Appellate Authority within 3 months of the order, along with the required pre-deposit โ if that doesn’t resolve it, the next step up is the GST Appellate Tribunal, then the High Court and Supreme Court on questions of law.

The first level of appeal against an adjudication order (like a demand under Section 73 or 74) goes to the Appellate Authority โ typically an Additional or Joint Commissioner (Appeals) โ through Form APL-01, filed within 3 months of the order being communicated to you.
If the outcome there still isn’t satisfactory, the next level is the GST Appellate Tribunal (GSTAT), which has recently become operational after years of the mechanism not being functional โ a gap that had left many taxpayers waiting for years to pursue a second appeal.
Beyond the Tribunal, further appeal is possible to the jurisdictional High Court, and ultimately the Supreme Court, but only on substantial questions of law, not simply because you disagree with the factual findings below.

Don’t let the 3-month window for the FIRST appeal slip while you’re still deciding on strategy โ the Appellate Authority has no power to condone a delay beyond a further single month, so a 5-month-old order is generally unappealable through this route at all.
