If Your Flat Already Has an Occupancy Certificate, Do You Still Pay GST?

Short answer

No โ€” if the ENTIRE sale consideration is paid after the Occupancy Certificate (or Completion Certificate) has been issued, or after the building’s first occupation, the transaction is treated as a sale of a completed building, which falls outside GST entirely under Schedule III. Only stamp duty applies.

If any part of your payment was made before the OC was issued (a booking amount, an instalment during construction), the transaction can instead be treated (at least for that portion) as an under-construction sale, which does attract GST.

This is why the exact structure and timing of a flat’s payment schedule relative to its OC date genuinely changes its tax treatment โ€” a ready-to-move-in flat bought entirely after OC is a fundamentally different GST transaction from the same flat bought earlier during construction, even if it’s physically the identical unit.
