What Happens If an Invoice Should Have Been E-Invoiced but Wasn’t?

Rule 48(5) is unambiguous about this: for a business required to e-invoice, an invoice issued WITHOUT going through the e-invoice registration portal and getting an Invoice Reference Number (IRN) is deemed to not be a valid invoice at all โ€” regardless of how correctly formatted and accurate the actual document looks.

That invalidity flows downstream to the BUYER’s ITC too โ€” a recipient generally cannot claim input tax credit on a supposed ‘tax invoice’ that legally doesn’t count as one, even if they’ve genuinely paid for the goods and the GST charged.

The fix, if caught in time, is to properly register the invoice on the e-invoice portal to generate the missing IRN, or where appropriate cancel and reissue the invoice correctly โ€” the earlier this is corrected, the less disruption it causes to the buyer’s ITC timeline.
