This is one of the stricter deadlines in GST procedure, and courts have consistently upheld it as an absolute outer limit rather than a soft guideline. The Appellate Authority’s power to excuse a delay is explicitly capped by the statute at one additional month โ it cannot stretch that further no matter how genuine the reason.
Once 4 months have passed from the order’s communication with no appeal filed, the ordinary appeal route is effectively closed. The only remaining option in genuinely exceptional circumstances is approaching the High Court through a writ petition, and courts have generally been reluctant to entertain that route just to bypass a missed statutory deadline, reserving it for truly extraordinary situations.
The clock starts from when the order is COMMUNICATED to you, not from the date printed on the order itself โ a distinction that matters if there was a delay in the order actually reaching you.
